CHANDIGARH: A Division Bench of the Punjab and Haryana High Court has issued notice of motion to PML Industries Limited, a company promoted and managed Dr A.S. Bindra, in a letters patent appeal (LPA) filed by Asset Reconstruction Company India Limited (ARCIL).
An LPA is an appeal before two judges of the same high court against the judgment of a single judge.
ARCIL has sought the quashing of January 11 orders passed by Justice KKanan, directing the Debt Recovery Appellate Tribunal (DART) to reconsider the case pertaining to recovery of the loan raised by PML from various financial institutions.
ARCIL stated that the company had earlier agreed on a one-time settlement of the loan in 2007, but the amount was not paid. Creditors then decided to withdraw the offer and initiate proceedings for taking over the unit, but PML approached DART, which directed PML to pay Rs 28 crore as an interim measure to retain its possession.
PML then approached the High Court, where Justice K Kanan, setting aside the DART orders, directed the Debt Recovery Tribunal (DRT) to examine the conditions strictly as per rules. Till the final decision, the company would be retaining possession of the unit.
In the LPA, ARCIL has held that the company had “not come to court with clean hands”.
ARCIL also sought Permission to take over possession of the unit in case non-payment.
NOTICE ON PIL
CHANDIGARH: The Punjab and Haryana High Court has issued notice of motion on a public interest litigation (PIL) challeriging the Government Punjab decision of one-year service extension and accruing promotional benefit to employees retiring between January 22 and December 31.
Petitioners Ravinder Singh Rana, Amardeep Singh and Lakhwinder Singh, all lawyers, argue that there’s huge unemployment in Punjab and no big industry is coming into the state, even as units are being moved to neighboring states where New Delhi has implemented tax break.
“The government order of January 22 is illegal, unjust, improper and in utter disregard of the Punjab Civil Services Rules,” they say.
The petitioners add that even the legal remembrance (LR) disagrees with this proposal of service extension to employees.
They have sought directions from the high court for quashing the government order. The court has issued notice to the respondent authorities, including the Punjab Chief Secretary and Secretary of the
Department of Personnel for March 29.
NOTICE TO HOME SECY, DGP ON EX-MLA’S PLEA
CHANDIGARH: A Division Bench of the Punjab and Haryana High Court has issued notice to the Haryana Home Secretary, Director General of Police, district police chief in Karnal and others on a latter patent appeal (LPA) by former Haryana MLA from Indri Rakesh Kamboj, who was assaulted in 2007.
Kamboj has sought independent inquiry into the matter.
The Bench has also put a stay on submission of final, police report in the trial court.
Kamboj had sought directions from the Bench for setting aside the orders of a Single Bench through which the state government had been ordered to register a case of assault and hand over the matter to a special investigating team.
Expressing dissatisfaction at the state investigation, Kamboj argues that without impleading ParupatASP Jagat Singh Hooda (a relative of the Chief Minister), Karnal DSP Surinder Pal and Yamunanagar SDM R.K Singh, the investigation has no meaning.
Kamboj, who is now in the Indian National Lok Dal, was in the ruling Congress and close to former chief minister Bhajan Lal at the time of assault. Later, he had joined the Haryana Janhit Congress as well.
