NEW DELHI: Students are not entitled to get refund of the fee deposited with the erstwhile institute even in case of intra university migration, the National Consumer Disputes Redressal Commission (NCDRC) has held.
“The university rules nowhere have stated that fee paid to the erstwhile institution will either be transfered or refunded to the student migrated to the new college,” the Commission, comprising members RN.P. Singh and S.K. Naik, said.
The Commission passed the order on a revision petition filed by Sonali Sharma challenging dismissal of her petition by the Punjab State Commission regarding fee refund after she had migrated to another educational institution.
Sharma has completed her second semester of MCA and deposited the fee of Rs 40,000 for third and fourth semesters. When Sharma migrated to the other institute, she asked for refund, but the former institute rejected her request.
“The State Commission has stated that the prospectus of the college clearly mentioned that dues once paid are not to be refunded in any case which was as good as a contract between the parties and binding on both,” the Commission said while dismissing the petition.
The NCDRC noted that regulations regarding migration of a student were governed by a college or institute rather than University.
